Motorola Granted Injunction in Germany Against Xbox, Win 7

When enforced, the sales injunction will ban the sale of several Microsoft products in Germany, including Xbox 360 and Windows 7.
The Mannheim Regional Court ruled that Microsoft infringed two of Motorola's technology patents when using certain H.264 video-compression formats in products including Xbox 360, Windows 7, Internet Explorer and Windows Media Player. However, Motorola is unable to act immediately on the ruling due to an ongoing investigation claiming the company is being ?unfair and unreasonable with its patents,? when demanding Microsoft pay $4 billion annually in royalties.
Microsoft commented on the recent judgement, stating, ?This is one step in a long process, and we are confident that Motorola will eventually be held to its promise to make its standard essential patents available on fair and reasonable terms for the benefit of consumers who enjoy video on the web. Motorola is prohibited from acting on today's decision, and our business in Germany will continue as usual while we appeal this decision and pursue the fundamental issue of Motorola's broken promise.?
The ?broken promise? referred to here are known as FRAND commitments that allow common technology such as video-compression formats available to companies at reasonable prices. Microsoft insists that $4 billion per year for patent licensing is far from reasonable, and until antitrust investigations have concluded, Microsoft can continue business in Germany.
Following the court ruling, Motorola stated, ?We are pleased that the Mannheim Court found that Microsoft products infringe Motorola Mobility's intellectual property. As a path forward, we remain open to resolving this matter. Fair compensation is all that we have been seeking for our intellectual property.?
On May 7th there will be a hearing in Seattle involving Motorola's ?unreasonable? demands and whether there has been a breach in FRAND commitments.
