What is your view on this eBay situation? $1,000's LOST

I sold a pair of Adidas Yeezy Boost 950 Duckboot Chocolate Color for $2,499 with a signed box and lanyard by Kanye West. The box had some damage to it including some slight wrinkling of the corners and in the bottom left corner a water spot that was warped about 3 inches long and 1 inch tall. Also, the lanyard (the signed part) had been ripped and professionally put back together (WITH CERTIFATE OF AUTH. STATING SO) The buyer then requested that I gave them a partial refund due to the damaged collectors item. I then give them the $200 partial refund because, I was still making nearly $800 profit. The buyer then goes and makes a return request for the total amount and askes for eBay assistance after I didn't agree to a 100% refund because they already for $200 from me. eBay then agrees on their side and I had to pay back the original total amount plus shipping and the $200 I already gave. (I had already listed on the return page that I gave a $200 refund via the original PayPal payment with evidence) It ended up coming WITHOUT THE SHOES! I recorded myself opening the package incase it came back not as I sent it. I then spend over 5 hours on the phone with eBay and they said I can get all my money back + the $200 partial refund if I send them the video. I then send them the video and they reply with something along the lines, "the package had a double layer of tape looking as if it had already been opened before the video filming" (IT WAS THE TAPE FROM WHEN I FIRST SENT IT, THE 2ND LAYER WAS THE TAPE THE GUY PUT BACK ON TO SEND IT BACK TO ME) "because of this, it seems you tampered with the package and may have removed the item(s) before filming. Because of this, the seller will keep the total refund amount and the case is closed"



In the end, I am out the shoes THE MAIN PART OF THIS LOT! $1,700+ shoes, $200 partial refund, and $137.29 spent on insured shipping both ways.

OPTION ONE: Let it go!


OPTION TWO: Go to court especially easy as the buyer lives in the same state as me and lives less than 2 hours from my house.

Please comment down below what you think about this situation and other possible approaches to solving this problem.
 
I had a similar situation happen to me. The buyer opened a dispute and won bc buyers always win disputes per eBay policy. I had already transferred money to my bank. They issued a refund and put a negative balance on my PayPal account. I called and told them I wouldn't be paying them back. They closed my account and I created a new one with same info. Still using it today with no blemish on credit. I guess my best advice is to be calm and professional but not intimidated. I even sold the item again on ebay since it was returned to me.

In case you're wondering the item was a wiring harness for a 2017 yukon from the firewall out. The guy said it wasn't for a 4x4 even though I took it out of a 4x4 that I drive everyday. Good luck.

Just curious, did you state on the auction that the package and item comes As-Is?

I would go ahead and file a theft report. Try every legal path because that's a lot of money to get stolen from you, not to mention eBay took the full amount back despite you already issuing a $200 partial refund. Hopefully you have documentation of that refund so you can show that to both eBay and the courts.

You can also try naming eBay to the lawsuit (if you do file one). That'll get their attention real fast.
 
Johnny Johnny S Snipeye I did list the item as-is and said to read the description and look at all of the images very carefully. I have sold over 1300 items on eBay and have never had a problem like this, I have spent another 6+ hours on the phone today with an attorney and eBay. After talking to eBay they advised me they will look into the problem and that the funds are still on hold to the sellers account and they will be on hold until this situation is over. I did get my original $200 partial refund back after a support chat with PayPal. I still was told I should talk to someone in my local minor claims court system to see possible options if it doesn't go 100% as planned. <--- (This is if eBay goes on their side still and the buyer completely ignores all attempts to contact.)

(P.S.
THE NEGATIVE BALANCE WAS CHARGED TO MY CREDIT CARD AND INSTANTLY FLAGGED AS FRAUD)

I say you go for it. Stealing is the lowest of the low, and he has it coming to him.

This is what I personally would do but I am not a lawyer so take my advice lightly. The guy is a scamming thief, it's over $1000 stolen (depending on State) and becomes felony theft, so long as you save all chat messages and covered your ass as far as giving him the partial refund, telling him that by buying it "as-is", etc... Should be a simple case in court. I found this post on /r/legaladvice which you might find useful. Might want to consider posting on there too :-)

Johnny Johnny NOW I AM PISSED!!! After talking to PayPal and eBay on the subject, AND!!!! my credit card they charged was blocked. IT AUTOMATICALLY DEFAULTED TO CHARGING MY DEBIT CARD. WORST OF IT ALL, IT WENT INTO THE F**KING PERSONS ACCOUNTS AND NOW THEIR EBAY ACCOUNT CAN'T BE FOUND WHEN I CLICK IT!

OPTION TWO is going to be the route I take at this point now that I'm out over $2000. Yes, I will be listing eBay as one of the defendants. I have done some research and some similar cases have happened in the past and when eBay is listed on a lawsuit, they usually do an out-of-court settlement for more than the original amount so they don't have to send a representative to court. I am going to my local police station tomorrow and also filing a police report on theft against the person with all the evidence I have. I have officially printed out multiple copies of all chat logs, images, and the return request pages for myself, police, court, and my lawyer.
 
Good. Sounds like you got 1) the support documentation, and 2) previous cases help support your decision to include eBay on the lawsuit as it was their poor handling of the situation is what caused the theft of your personal property (item sold and payment). Hopefully you are made whole. At this point, I would probably stop posting about the specific details of the situation for now, and work with your attorney and the court system. And sometime down the road, you can just post us an update and say, "They settled out of court," or even better, "The police arrested the guy, and he's a known thief..."
 
Definitely tell the police of the theft and bring it to court. Hopefully they can get a subpoena and search his home for the shoes. I'm sure law enforcement will find evidence and he'll be charged. When he ends up having to pay a fine or going to jail, make sure your last words to him are "scammer gets scammed".
 
crazy story and scary--I ve heard of things like this on ebay even for a lot more money -I hope you win eventually and good luck -a lot of scammers out there
