I've never liked the way we handle arrests. I feel it encourages the rushing of evidence gathering, discourages questioning and all around frustrates civs.

WHAT IF, we brought forth a new process.

When we make arrests not based on a warrant, just in street arrests, the subject is taken into custody, brought down to MRPD for a final search and released pending charges.

At this point, the officer must write their report, provide the necessary evidence whether it be the statement itself, any evidence found on the person, images of the scene, mugshots, stuff like that.

THEN, the report is referred to a supervisor for review and approval of sentencing. A warrant is then requested for that individual. The individual is then ordered via Twitter or direct email to surrender themselves at MRPD for sentencing. If they refuse, the warrant is then enacted and they will be found and brought straight in, adding any flight charges or possession charges on the spot from the effected warrant arrest. You can NOT be released when a warrant is being enacted for a prior arrest and release charge.

This opens another avenue. IF the individual wishes to take their charges to court, the warrant will not be approved, a court case will be set IF the judge approves it is a valid case worth taking to court and the subject will be sentenced after the court case.

This cuts out the whole sitting in the cells stuff, no more need for time served. The subject is initially only brought to MRPD, mugshot gathered and sent on their way if no questions need to be asked. If questions do need to be asked, they may have their attorney present.

I think that this would open a LOT of avenues for roleplay, it would give time for officers to build cases, it would open up more RP for court AND it would stop us from sentencing people before they've had a chance to fight it in court.

As for warrants, they should be served and sentenced without release. These would be the only cases where you would be sentenced before court as a Judge, the Sheriff or the Chief of Police has signed said warrant which means enough evidence was brought forth to accomodate the requirement for sentencing.

I'm hoping I've just cracked the code to how we handle arrests. What do you all think?

Sure it would mean immediately releasing someone after robbing a bank, but you've taken their winnings, you've gotten their goods, they are only walking away to face their sentence at a later date and time or to fight the charges in court. It's really a win win I think.

I do like it I can see this possibly working. Give people the option of if you wanna take it to court you will be released but if you plead guilty in the cell then you can go to prion it gives people the ability to rp with cops in more ways I like it.
 
What would you say to those who wish to do time on the spot? If I've been caught doing a bank robbery, I'd rather be sentenced than have to wait a couple of days to serve my time. Can I plead guility and be sentenced right away?
 
I want to start off by saying, I love outside the box ideas like this, while it may be a little crazy, its still something that should be talked about and considered.

I think this idea is crazy, not in a good or bad way, just crazy. It would be interesting and weird if instead of; (someone breaks law -> police catch subject -> Subject is arrested -> Subject Serves Sentence) it would be; (someone breaks law -> police catch subject -> investigation is started -> full investigation happens -> request warrant (if applicable) -> apprehension of subject -> Subject is arrested -> subject serves sentence)

I also dislike how fast arrests are, no room for roleplay imo. at least a good amount of roleplay, the proposed system would not only make arrests take longer (both a good and bad thing) but also allow police to do actual cases. Though, this could have a few problems.
1. Criminals may feel on the hook longer than the sentence would've been (both good and bad)​
2. Will slow down arrest process a ton (Good for RP[for both sides imo] and case building)​
3. Some criminals would rather not wait to be sentenced, they would rather do the time right there and then.​

Hardly any real problems I can mention, other than number 3 there.

I disagree with having supervisors review officers reports, supervisors and command in general should focus on teaching how to make a report, rather than back seat every report for every arrest ever. the reports shall be reviewed once a warrant is requested, so doubling up is pointless. I do feel like this proposed arrest system is basically like posting bail, but police just does it automatically. (improves roleplay attendance across the board, so instead of getting arrested at 6pm for 3 hours [prime time] instead you can go back to roleplay right away.)

Then you would see a meta where people would ask the cop to arrest them off prime time so when they get arrested, its not during prime time, big ups there. it also could make bench trials easier since the person isn't sitting in the cells for 2 hours, and instead out and roleplaying while waiting.

I think the idea of having people go to court to get sentenced is cool, but I don't think its very possible atm (if thats what you meant.) if you meant that people with warrants should be sentenced immediately I agree (as long as they can still fight it in court if they want to) I think in general, after a warrant is requested after the investigation, they should be brought in and arrested like we would do normally.

I think this is a good idea that civilians/crims should give feedback on and SADPS should deeply consider, as well as leadership looking at it as well for their insight.

At the end of the day though, I think this change could be done by law enforcement without changing a damn thing, just policy and how we do things. it doesn't need anything to be added or removed or changed which is probably the best part. not to mention this is 100% in law enforcement power.

There are things that I like about this however I want to bring up a few things:

* I think this idea would work well on some basic crimes like unlawful flight or some other basic crimes but maybe would be an idea to give the CRIM the CHOICE to either go ahead and serve their time to get it over with or to go free and set a court date. However that process would need to get fleshed out.

** Normal arrests from unlawful flight, basic store robberies and bank robberies for my crim character I'd rather plead guilty and go to jail and move on honestly.

* In terms of the time it takes to do the initial investigation on scene - This is where the new MDT system comes in handy and some additional training is needed. Currently, the "primary" is responsible to do everything while all other officers just move on or stand there not doing anything. In my opinion, all officers that were involved in the scene should be jumping in to assist. What I mean by that is, say there's 4 officers involved, the primary gets things going with the suspect while the other officers are processing vehicles used (getting tow, searching vehicle, taking pictures etc) as well as searching for any evidence on scene. By the time that the "primary officer gets the suspect back to MRPD there should already be an incident started by either them or another officer on scene with images uploaded / evidence documented. That way it makes the report completion a group effort and a lot more expedient. The role play happens while in the vehicle and between parties in the cells.

Like I said though, on larger cases, ongoing investigations I could see where the suspect was charged and then set a court date as long as the DOJ system has the staffing available to actually be able to handle all of the cases that would be coming their way. There are dozens of arrests on a daily basis and the fear would be that those would then clog up the DOJ system down the line. My other hesitation is that say we arrest a group of 4 after they kill a bunch of officers on duty. I would feel really conflicted allowing that criminal who just willingly killed others right back onto the street to potentially take more lives.

I agree with this. I kind of overthought that point.

So I can see my wording may have been a bit confusing here. On initial arrest, the subject will be released after mugshot and being searched pending charges(Unless they wish to serve time immediately, then we can book them right there). If they are released, charges will be put forth alongside a report, then the officer will seek the warrant, as you requested. This warrant will ONLY be approved if the subject is not seeking to go to court, they will then be ordered via DM or twitter to surrender themselves at MRPD for sentencing. IF they DO want to take it to court after being released, a warrant will NOT be approved, a court date will be set. They will have X time to organize a court date before a warrant is served for their arrest and sentencing(This sentence is for those who just claim they want to take it to court to dodge the warrant and never actually take it to court). I hope this better explains this section.

Otherwise, they will be released pending charges and can CHOOSE to to take it to court via attorney within X time otherwise a warrant will be placed and they will be DM'd or a post made on Twitter ordering them to surrender themselves at MRPD for sentencing.

In regards to this, I agree, training is important and these points are good. But I still feel this new design promotes more opportunity for roleplay rather than officers booking on the spot.

In regards to this, I believe this should be up to the statutes to be updated. If you feel a crime is worth holding until trial, then it should say so in the statutes as statutes currently do. Otherwise, they should be released in my opinion. This is a simple matter of updating the statutes to match the new system based on severity of the crime. Perhaps Aggravated assault on ES times X amount of officers should be a hold until trial crime in the statutes, just a thought.

I WOULD recommend some kind of policy being added with this where if you were released, you need to wait 30 minutes or so before committing another crime. This should be fairly common sense as we are a whitelisted server, but you never know. We just don't want people robbing a bank, getting released and robbing a store next.

We've tried player run bail before. It fell apart nearly immediately, I think that having it be player run is the failure by design. HOWEVER, bounty hunting could still be a thing, PD is just technically providing the immediate bail, bounty hunters could potentially pursue the warranted individuals down the road.
 
So what if y’all post saying “come to MRPD” but said person isn’t on for a day or so and you issue a warrant would you search their property now catching them for more? Or would it just be a warrant ie pulled over they are going to jail that’s it

Search warrants and arrest warrants are two different things. You would not be able to search a property on a simple arrest warrant. Officers would need probable cause to believe you are in a residence to search it for you, such as seeing you enter your apartment in a pursuit. Otherwise they would need a search warrant to search your property for you and a judge would need enough evidence suggesting you would be at said property to sign that search warrant.
