These Terms of Service ("Terms") govern your access to and use of the EdgeGamers community, including our website, our game servers, our Discord server, and any other related services we operate (collectively, the "Services").

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Who We Are

The Services are operated by EdgeGamers, LLC ("EdgeGamers", "we", "us", or "our"), a limited liability company. EdgeGamers operates an online gaming community.

2. Eligibility

The Services are only available to users who are at least 13 years old. By registering for or using the Services, you represent that you are 13 or older. If we learn that a user is under 13, we will anonymize the account in accordance with our Privacy Policy.

Some Services or game servers may have additional age requirements based on the rating of the underlying game. You are responsible for ensuring you meet any such requirements.

3. Your Account

When you register, you agree to:

  • Provide accurate information and keep it current
  • Keep your password and account credentials confidential
  • Not share, sell, transfer, or allow others to use your account
  • Notify us promptly through the Contact Leadership forum if you believe your account has been compromised

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

You may not register or maintain multiple accounts to evade enforcement actions, manipulate community processes, or otherwise circumvent these Terms.

4. Code of Conduct

Your use of the Services is governed by our Code of Conduct and the game-specific rules linked from it, available at https://www.edgegamers.com/pages/code-of-conduct/, which are incorporated into these Terms by reference. Without limiting the Code of Conduct, you agree that you will not:

  • Harass, threaten, stalk, dox, or abuse any other user, staff member, or third party
  • Post hate speech, slurs, or content that discriminates against any protected group
  • Post, link to, or distribute illegal content, including but not limited to content depicting the sexual exploitation of minors
  • Use cheats, hacks, exploits, scripts, bots, or unauthorized third-party software on our game servers or platforms
  • Evade bans, suspensions, or other enforcement actions, including by creating alternate accounts
  • Spam, flood, or post commercial advertisements without prior written permission
  • Impersonate EdgeGamers staff, other users, or any third party
  • Share personal information about other users without their consent
  • Distribute malware, viruses, or other harmful code
  • Use the Services for any unlawful purpose or in violation of any applicable law
  • Disrupt, interfere with, or attempt to gain unauthorized access to the Services or other users' accounts
  • Scrape, harvest, or otherwise collect data from the Services in bulk without permission

Individual game servers and platforms may have additional rules linked from the Code of Conduct page. Those rules apply in addition to these Terms.

5. User Content

You retain ownership of any content you post, upload, or otherwise submit to the Services ("User Content"), including forum posts, messages, voice communications, screenshots, videos, and in-game chat.

By submitting User Content, you grant EdgeGamers a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, modify, adapt, publish, distribute, and otherwise use the User Content in connection with operating and promoting the Services. This license continues even after your account is closed or anonymized, with respect to any User Content already submitted.

You represent and warrant that:

  • You own or have the necessary rights to submit your User Content
  • Your User Content does not infringe the rights of any third party
  • Your User Content does not violate these Terms, the Code of Conduct, or any applicable law

We may, but are not obligated to, review, moderate, edit, remove, or refuse to display any User Content at our discretion.

Do not submit anything to the Services that you consider private or confidential. All User Content may be reviewed by staff and may be transmitted to third-party services we use to operate the Services (such as spam-prevention, hosting, and content delivery providers).

6. Moderation and Enforcement

We may, at our sole discretion and without prior notice:

  • Issue warnings, mute, kick, suspend, or permanently ban any user
  • Remove, edit, or hide any User Content
  • Restrict access to any portion of the Services
  • Anonymize, suspend, or terminate any account

Bans and other enforcement actions may be tied to your username, account, Steam ID, IP address, hardware identifiers, or any other identifiers we determine necessary to enforce the action and prevent evasion.

We are not obligated to provide a reason for any enforcement action, and we are under no obligation to restore content or accounts that have been removed, suspended, or terminated. Appeals, where available, are governed by the Code of Conduct.

7. Donations, Purchases, and Dedicated Supporter Subscriptions

Store Purchases and One-Time Donations

Store purchases and one-time donations are processed by Tebex Limited. All store purchases and donations are final and non-refundable. By completing a transaction, you acknowledge that you are not entitled to a refund under any circumstances, including but not limited to:

  • Account suspension, ban, or anonymization
  • Removal or change of perks, items, or features
  • Server downtime, discontinuation, or migration
  • Dissatisfaction with the Services

Dedicated Supporter Subscriptions

Dedicated Supporter subscriptions are recurring billing arrangements processed by Stripe, Inc. By subscribing, you authorize EdgeGamers (through Stripe) to charge your payment method on a recurring basis at the interval and amount disclosed at the time of subscription, until you cancel.

You may cancel your subscription at any time through your account settings or by contacting us through the Contact Leadership forum. Cancellation will stop future billing, effective at the end of the current billing period. Cancellation does not entitle you to a refund of any amount already paid, including the current billing period during which you cancel.

Dedicated Supporter perks are not guaranteed and may be modified, suspended, or discontinued at any time without refund. Perks will be revoked if your account is suspended, banned, anonymized, or otherwise terminated for any reason, with no refund of any subscription fee.

No Refunds

For clarity, no refunds will be issued for any donation, purchase, or subscription payment for any reason, except where required by applicable law.

8. Intellectual Property

The EdgeGamers name, logo, branding, and original content of the Services (excluding User Content) are owned by EdgeGamers and protected by trademark, copyright, and other intellectual property laws. You may not use any of our marks, branding, or proprietary content without our prior written permission.

The games, gameplay assets, characters, and related intellectual property featured on our game servers are owned by their respective publishers and licensors. Our use of those games is subject to the terms of the game publishers' end-user license agreements, and your use of those games on our servers must comply with those agreements.

9. Intellectual Property Complaints

Copyright Complaints (DMCA)

If you believe that content on the Services infringes your copyright, you may submit a notice to [email protected]. Notices should contain the following information required by the Digital Millennium Copyright Act:

  • Your physical or electronic signature
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the allegedly infringing material and its location on the Services
  • Your contact information (name, address, telephone, email)
  • A statement, under penalty of perjury, that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in the notice is accurate, and that you are the copyright owner or are authorized to act on the copyright owner's behalf

We will respond to valid DMCA notices in accordance with applicable law. Submitting a false or fraudulent notice may subject you to liability.

Trademark Complaints

If you believe that content on the Services infringes your trademark rights, you may submit a notice to [email protected]. Notices should contain:

  • Identification of the trademark, including registration number and jurisdiction if applicable (or a description of your common-law rights)
  • Identification of the allegedly infringing material and its location on the Services
  • Your contact information (name, address, telephone, email)
  • A statement, made in good faith, that the use of the material in the manner complained of is not authorized by you, your agent, or the law
  • Your physical or electronic signature

We will review and respond to valid trademark complaints. Submitting a false or fraudulent notice may subject you to liability.

10. Third-Party Services

The Services interact with and rely on third-party services, including Tebex, Stripe, Discord, Steam, game publishers, hosting providers, and others. We are not responsible for the availability, content, accuracy, or practices of any third-party service. Your use of those services is governed by their own terms and policies.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, EdgeGamers disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free
  • Any defects will be corrected
  • The Services or any servers that make them available are free of viruses or other harmful components
  • Any User Content or third-party content is accurate, complete, or reliable

You use the Services at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, EdgeGamers and its officers, members, contractors, agents, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the Services, including but not limited to loss of data, loss of access, loss of profits, loss of goodwill, or interruption of service, even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or related to these Terms or the Services will not exceed the greater of (a) the total amount you have paid to EdgeGamers in the twelve months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless EdgeGamers and its officers, members, contractors, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your use of the Services
  • Your User Content
  • Your violation of these Terms or the Code of Conduct
  • Your violation of any applicable law or third-party right

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

14. Governing Law and Venue

These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

You agree that any dispute, claim, or action arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may modify these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will provide additional notice (such as a forum announcement or, where required by law, direct notice). Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes.

If you do not agree to the updated Terms, you must stop using the Services.

16. Termination

You may stop using the Services at any time. You may also request that your account be anonymized in accordance with the Privacy Policy.

We may suspend or terminate your access to the Services at any time, for any reason or no reason, with or without notice. Sections of these Terms that by their nature should survive termination (including Sections 5, 7, 8, 11, 12, 13, and 14) will survive.

17. Miscellaneous

  • Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
  • Entire agreement: These Terms, together with the Privacy Policy and the Code of Conduct, constitute the entire agreement between you and EdgeGamers regarding the Services and supersede any prior agreements.
  • Assignment: You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms at any time without notice.
  • No agency: Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and EdgeGamers.
  • Headings: Section headings are for convenience only and do not affect interpretation.
