Ok, so today someone asked me to use my phone to call gamestop, his name was Mikey, he gave it to a guy named Henry and made the Battletoads prank. They recorded my number and reported it, I got my phone back, but now im stuck with the possibility of a fine. If I gave the police the full name of the guy that made the call and they compared it to the recording, could I be saved?
 
Your at fault, although Im not sure if making a prank call is Illegal. You should be more careful of who uses your phone.
 
Making a prank phone call is not illegal.
Just call the gamestop, ask if they have battletoads, and hang up. xD
 
If done repeatedly you can be charged for harassment in some cases. But one time...I think you'll be fine

You should be fine, but next time you should ask the person who's borrowing the phone what they're using it for.
 
Just apologize, and if they compare your voice with the recording, I'm pretty sure they will let you off the hook.
 
fine for what? if its criminal then no..fault needs mens rea (mental means of doing wrong). As far as fine did he order anything? or cause the company any loss? if not you souldnt be charged with a fine, also not against the law to prank call - if anything its criminal mischief and you wouldnt be charged as you didnt make the call, Lending your phone for a prank call doesnt mean anything, plus you didnt know...dont worry about it.
 
You should be fine, its just a prank call. Not like to bankrupt them.
 
In legal terms, (I had an online friend who prank called frequently and was caught) federal law in the US covers multiple offenses directed at the same party as being criminal harassment. It's considered a misdemeanor unless threats of physical/property/financial harm were made. To my best knowledge a single phone call is not illegal, but this will vary from state to state based up local laws/statutes. In New Hampshire and by higher law, one call does not constitute harassment.


Edit: Being your phone, you assume responsibility but if a recording of the call was made it can't hurt to explain the situation. Doing nothing is the worst option.

I'm going to have to call BS. You can your phone to some random person and then they called Gamestop and pulled a prank call. Yeah right.
