And what would they sue for..? Anybody can buy a retail copy of the OS, and try to get it running -- but it's up to Apple what hardware they support. That'd be like saying MS has the right to sue Apple over Boot Camp.

Yes, anyone can buy the OS but it is illegal to RUN that OS on anything but Apple hardware. Not supported hardware like the x86 project has a list of, Apple hardware only. Period. Put Mac on anything not purchased directly from them or qualified reseller, and it's a breach of the end user license agreement. Apple makes their money from selling their hardware their way with their prices. They could easily sell the OS to anyone with a desktop and fix hardware compatibility issues in 2 months, but they won't and won't allow others too b/c that takes away from revenue. If they let this one slip through, then more will follow. That isn't going to happen. Even more likely is that if you were to purchase the fake-Mac from them, you'd likely have some ramifications as well, the least of which would be sending your Mac back to be destroyed. Steve Jobs and his lawyers are some brilliant minds. I wouldn't push it.
