GTA V RP - A Lawyer/Judge Organization

Bottom line, we need lawyers.

Currently we have a system where an officer Mirandizes us notifying us of our right to an attorney that we never get, charging us with charges we can never fight and relying on officers in a video game to be 100% honest and correct all the time AS WELL as an INTERNAL complaint system that allows officers to investigate officers of wrong doing.

As you might be able to guess, the legal system with this design is a BIT one sided.

I propose an Attorney Organization, not run by myself, but someone whom is willing and interested because I've got a security company on my plate.

This organization MUST be contacted by PD before they put a suspect in prison or fine them. The attorney should be given the opportunity to speak to their client, then provide an offer or discussion with the officer making the arrest. If the officer refuses to agree to the attorney's terms, the case must go to court. While waiting for court, with charges filed (BUT NO PUNISHMENT GIVEN) the suspect will be held in the jail cell for an available judge to hear the case.

If no judge is available, the officer and the attorney may re-discuss the terms OR the suspect must be released until a scheduled court date with the charges on his file. IF bodycam footage is available of what is CLEARLY the suspect CLEARLY committing said crime AND the judge is unavailable, the officer may choose to submit punishment, however the case will later be reviewed by a judge for potential wrong doing.

As for civilian lawsuits, civilians must pay a minimum fee to an attorney in order to file a lawsuit for any reason on another individual. This is to prevent a ridiculous number of silly cases being brought to court, maybe a $50,000 filing fee for a case. However all cases involving a suspect being arrested are provided with an attorney for free as they are paid by the city(Automatic organization paychecks).

The judge will determine the final punishment for the suspect.

Simple traffic stops and tickets are up to police discretion, however all arrests must be handled through this system.

TLDR: We need an oversight system for the PD that is NOT PD or FIB, it needs to be a civilian run organization.

Ultimately I feel this will allow more opportunities for Roleplay and more interesting interactions with PD, it will also allow for a far less potentially bias oversight system.

EDIT: With this concept, since we are adding a lot more work to the punishment system, I am also suggesting higher punishments.

I think before we even consider this, we need a permanent CAD system for the police so everything can actually be logged. (not just the current one that just shows jail times but one that you can lookup an ID and find any warrants, previous tickets, warnings etc.)

I 100% agree, we need a records system to make this work properly.

During general booking procedures such as searches and general booking questioning (name, DOB, etc.) , arrestees have no right to have an attorney present. What it boils down to, is the only time an attorney is to be present is during questioning. This questioning doesn't happen often, because most of the time our officers have more than enough evidence to charge the person and do not need to question them. I can't see attorneys being that big of a thing because of this.

Evidence needs to be proven. Your witness statement does not give you the right to imprison someone. Officers in real life arrest the suspect, he then waits for his court date to be punished where he can either take it to trial (The judge) or accept that he is guilty and serve the punishment(The judge). At no point does the officer provide punishment for crimes.

The description I have given above is the translation of the real life legal system into a workable one ingame. It basically means you can arrest a suspect and bring them down to the cell in PD, but you may not send them to prison or fine them without them being able to discuss their case with an attorney and being given the opportunity to fight your charges in court where you will need to provide the evidence that supports your accusations.

Every part of this involves the attorneys.

While that is true, what's also true is that officers do not have the right to pass a sentence on their own. They merely can press charges to which then it'll go further, in this exact order.

After someone is arrested and booked by a PD, they are allowed to contact their attorney while waiting for a court hearing. They must be allowed by law to meet with their attorney before their hearing. Then during the hearing, the Judge will read the defendant their charges, and decide whether they are guilty or not. (ex. Guilty/Not guilty/No contest). If the defendant decides to plead not guilty, it is then up to the Government to prove beyond a reasonable doubt that the defendant is guilty.

And then there's a whoooooooole lot more after this. But it's un-necessary. I personally would like to see a system in which the PD may simply book their subject, have an attorney (if present) meet with the client, and have it move before a judge. The judge, a bipartisan elected member, would listen to each side's argument and come down with a ruling. It would be simple enough to implement in game and would balance the scales.
 
Ya definitely we need some form of Court system where we have an attorney and judge and like a traffic judge or something like that
 
To implement something like this is why I initially suggested 7 day prison times. Not to make someone serve a 7 day sentence but to give time for court preparations and a hearing for their actual sentence. Just couldn't get the jail sentence to degrade while offline which sucked.

Also this will increase overall duration in police custody, and theres always pushback to that.
 
It would give a lot more meaning to crime. Meaning if you're gonna rob someone, you're gonna understand the weight of the possible consequences. Our 20-1hr jail sentences don't do that.

I think giving the weight of consquences is good because in real life it is the same thing and we advertise on the title of out server as realistic rp so i think it will boost rp and reduce crime so the stores can open up on the server again

Adam Adam i got arrested once for 36 bags of meth by Jay only took like 2 minutes from my cell to prison.
The other time was by jay again for 156 opium and that took a little longer cuz i had a lawyer coming from LS and we were in the county

I didn't say every interaction results in a complaint about the booking process, just that we already get complaints that it takes too long.

Adam Adam For the record, people will always complain. But this is a roleplay server and if their complaint is that the roleplay process takes too long, I mean maybe they need to find a different server. We're here for the content of that roleplay encounter, not JUST their crime and then poof to jail so they can commit more crimes faster.

However, I think the issue you get complaints about is more so the trolling that occurs from officers where they intentionally drag out a scene because they don't like a person's roleplay OR when officers leave someone in a cell waiting for questioning for half an hour, question them for 3 minutes and then leave them another 15 minutes before sentencing.

It's circumstances like this where changing the system up to what I am describing would benefit. While the officers may arrest the suspect for an alleged crime, they can't actually question without an attorney, so while the officer is investigating and questioning other individuals, the suspect would be speaking with their attorney. This provides content for both the officers AND the suspect so it's not just mind numbingly standing there waiting to be questioned while the officers get their roleplay scenario alone for the most part.

It would take some tweaking to exactly how it works, but whatever we can do to leave as little content-less moments as possible should be the goal.

I'd definitely love to see something like this implemented into the server, as it is now there isn't much realism when being arrested. You're just mirandized and then sentenced with no option to prove your innocence in a court of law. Adding a system like this not only increases the realism of being arrested and sentenced but also adds tons of potential RP for both Civs and Officers.
